1.4 Membership Cards and Access

Membership cards or access devices are non-transferable and must not be shared with others. Allowing others to use your membership card or access credentials may result in termination of your membership without refund.

2. Payments and Fees

For ongoing memberships, you authorize us to charge your payment method on a recurring basis according to your selected membership plan. Payments will continue until your membership is canceled or terminated in accordance with these Terms.

2.3 Price Changes

We reserve the right to adjust our membership fees and other charges. For existing members, we will provide at least 30 days' notice before any price changes take effect.

2.4 Late Payments

If your payment is declined or late, we may suspend your access to our Services until payment is received. A late fee may apply for overdue payments as specified in your membership agreement.

3. User Responsibilities

3.1 Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to use our Services:

• To harass, abuse, or harm another person
• To impersonate or misrepresent your affiliation with any person or entity
• To engage in any conduct that restricts or inhibits anyone's use or enjoyment of our Services
• To attempt to gain unauthorized access to our systems or other members' accounts
• To introduce viruses, trojans, worms, logic bombs, or other harmful material

3.2 User Content

You may have the opportunity to post, submit, or share content through our Services, such as comments, reviews, or social media posts ("User Content"). You retain ownership of your User Content, but you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, publish, and distribute your User Content in connection with our Services.

You acknowledge that engaging in physical activity carries inherent risks and agree to consult with a healthcare professional before beginning any exercise program.

4. Facilities and Equipment Use

4.1 Facility Rules

When using our physical facilities, you agree to comply with all posted rules and staff instructions, including but not limited to:

• Wearing appropriate athletic attire and footwear
• Using a towel during workouts
• Wiping down equipment after use
• Returning weights and equipment to designated storage areas
• Respecting time limits on equipment during busy periods
• Refraining from loud, offensive, or disruptive behavior

4.2 Equipment Use

You agree to use all equipment properly and as intended. Misuse of equipment that results in damage may result in charges for repair or replacement. If you are unsure how to use any piece of equipment, please ask a staff member for assistance.

4.3 Class Reservations

Some services, such as group fitness classes, may require advance reservation. You agree to follow the reservation and cancellation policies for these services. Repeated no-shows or late cancellations may result in restrictions on future reservations.

4.4 Personal Belongings

We provide lockers for temporary use during your visit to our facilities. However, we are not responsible for lost, stolen, or damaged personal property. Valuable items should not be brought to our facilities or should be secured in lockers.

5. Intellectual Property

5.1 Our Intellectual Property

The PirlatSwap name, logo, website, and content, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, are the property of PirlatSwap or its licensors and are protected by copyright, trademark, and other intellectual property laws.

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our Services for personal, non-commercial purposes. This license does not include:

• Modifying or copying our materials
• Using our materials for any commercial purpose
• Attempting to decompile or reverse engineer any software contained on our website
• Removing any copyright or other proprietary notations
• Transferring the materials to another person or "mirroring" the materials on any other server

This license will terminate automatically if you violate any of these restrictions, and we may terminate it at any time.

5.3 Feedback

If you provide us with feedback, suggestions, or ideas regarding our Services, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, publish, and distribute the feedback for any purpose without compensation to you.

7. Limitation of Liability

To the fullest extent permitted by law, PirlatSwap, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use our Services
• Any conduct or content of any third party on our Services
• Any content obtained from our Services
• Unauthorized access, use, or alteration of your transmissions or content
• Personal injury or property damage resulting from your use of our facilities or equipment

In no event shall our total liability to you for all claims exceed the amount you have paid to us in the past six months for Services.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

Upon termination, your right to use our Services will cease immediately. If your account or membership is terminated, you remain liable for all amounts due up to and including the date of termination.
